1. What you are about to pay for

A monthly or annual subscription that lets you receive on Telegram notifications generated by the experimental detection module (free-fall, impact, oscillation, listening). Notifications come from an on-device classifier of the PoC and from aggregation of public feeds. This is not an official seismic alerting system. It does not replace communications from civil protection agencies, INGV, USGS or any authority.

Prices and periodicity are shown on Stripe Checkout at the next step. Renewal is automatic until cancellation. Cancellation stops renewal but does not generate pro-rata refunds.

2. Mandatory blocks — read and tick everything

Intended use. I understand that Siesmic is a personal-awareness social experiment. I will use it only for myself, autonomously, as a "cognitive nudge" about events that have already happened or are ongoing. I will not use it as a primary alarm tool, not for third parties, and not for medical, emergency or civil-protection purposes.

MDR / AI Act / public alerting exclusion. I acknowledge the service: (a) is not a medical device (EU Reg. 2017/745), (b) is not a high-risk AI system under EU Reg. 2024/1689 (AI Act), (c) is not a public alerting service under Directive (EU) 2018/1972 art. 110 or Italian Legislative Decree 1/2018. I will not invoke it before a court or authority as if it were.

Ban on installation for vulnerable third parties. I will not install, share or delegate alert reception to minors, non-autonomous elderly, persons with cognitive disabilities, patients, guests, uninformed cohabitants or anyone who has not read and personally accepted this page. I personally assume the consequences of any misuse of my account.

Italian Civil Code article 1229 limit. I have read that Italian law forbids excluding in advance the Holder's liability for fraud (dolo) and gross negligence. So my waivers below cover only light negligence and force majeure, and no clause of this text or of the Terms can immunize the Holder for fraud or gross negligence attributable to him.

14-day withdrawal — informed waiver under article 59(o) Italian Consumer Code. I am a consumer and I have the 14-day withdrawal right (articles 52 ff. of Italian Legislative Decree 206/2005). I expressly request the service to start immediately upon payment, before the 14 days expire, and I acknowledge that with the start of execution I will lose my withdrawal right for the part already performed, under article 59(o) of Italian Legislative Decree 206/2005. Without this tick I cannot complete the purchase.

Specific GDPR consent. I consent to the processing of the following personal data strictly necessary to deliver the service (legal basis: art. 6(1)(b) GDPR — contract): email, Stripe customer ID, Telegram chat_id, technical logs, click-wrap acceptance register (text + hash + IP + timestamp). Article 15-22 GDPR rights requests go to [email protected]. Full notice in Privacy v2.

Telegram as processor. I understand alerts pass through Telegram FZ-LLC servers (Dubai, UAE) and its global sub-processors. Extra-EU transfer governed by the platform's standard clauses. If this is not acceptable to me, I cannot use the service.

Stripe as payment processor. Payment is handled by Stripe Payments Europe, Ltd. (Ireland) with possible extra-EU sub-processors covered by standard contractual clauses. The Holder only receives transactional metadata from Stripe (ID, status, amount, last 4 digits) and not full card data.

No performance warranty. No guarantee that an alert arrives, arrives in time, arrives without false positives, arrives without false negatives. Telegram network, mobile network, VPS, on-device classifier can fail at any moment. I will not act as if this channel were reliable.

No insurance coverage. The Holder does not carry professional liability insurance for this service. In case of damage, my claims are limited to the limits allowed by law (Italian Civil Code articles 1229, 1490 ff. and Consumer Code) and not beyond.

Social experiment, not product. I understand I am paying to access a personal experiment by the Holder, not to purchase an industrial product or a regulated professional service (engineering, medicine, public safety). If I need a professional alerting service, I go to civil protection, INGV or a certified operator.
